Attorney Aleksandr Troyb is honored to have been asked to participate as a speaker at the Annual Conference of the American Immigration Lawyers Association. Due to the pandemic, the conference is scheduled to take place virtually from July 20, 2020 through July 23, 2020. On July 20, 2020, Attorney Troyb will speak on the subject of naturalization and the current immigration laws, regulations and adjudication criteria affecting applications for naturalization. On July 21, 2020, Attorney Troyb will participate on a panel where experienced practitioners will assist newer practitioners with problems and challenging cases.

Extending ESTA/Visa Waiver Participants (VWP) Periods of Admission due to inability to depart the US related to COVID-19.

Note: As of this writing, this blog only applies to individuals who were admitted to enter the United States through John F. Kennedy International Airport in New York, New York and Newark Liberty International Airport in Newark, New Jersey.

As the Coronavirus (COVID-19) is continuing to impact travel and daily lives across the United States (US), travelers who legally entered the US by way of the ESTA/Visa Waiver program (VWP) may find themselves unable to depart the U.S, before their current period of admission will end.  Earlier today, U.S. Customs and Border Protection (CBP) Deferred Inspections sites at John F. Kennedy International Airport in New York, New York and Newark Liberty International Airport in Newark, New Jersey provided guidance to individuals who find themselves in this situation.

Department of Homeland Security Warns Immigrants Of Scam Involving Its Telephone Numbers

Earlier today, the Office of the Citizenship and Immigration Services Ombudsman (Ombudsman) warned immigrants and the general public of reports that certain Department of Homeland Security (DHS) telephone numbers, including the Ombudsman’s main telephone number, have been used recently as part of a telephone spoofing scam targeting individuals throughout the country.  Spoofing is the deliberate falsifying of information transmitted to a caller ID display to disguise an identity.

The Ombudsman’s Office numbers (202-357-8100 and 1-855-882-8100) appear to have been compromised.  The scammers use various tactics, such as the threat of identity theft, to elicit sensitive information.  Very little is known at this time, but the department warned the public that it – and any government office – would never ask for sensitive information over the telephone, such as Social Security numbers or credit card information.

Can BUSINESS-PEOPLE Get Workers’ Compensation Benefits? YES!

There is a common misconception out there that workers' compensation benefits are only available to laborers and union workers, and not to people working in white-collar jobs and professions. I have heard this from clients so often that I wanted to share a story with you in hopes that more people will know that they may be eligible to get assistance at a very difficult time in their lives.

I recently asked my friend Jim, an engineer for a Fortune 500 company, where he had been, since I had not seen him in several weeks.  He told me that he was recovering from a heart attack he had experienced while traveling for work to a plant in Iowa.  Jim explained this happened when he was at LaGuardia Airport. He had been delayed in a long security line, was pulling his carry-on with a briefcase on top, and was rushing to the departure gate, when he felt a sharp pain in his chest. He had to sit down in the middle of the concourse. Thankfully, a quick-thinking security officer called an ambulance, and Jim was taken to a nearby hospital.

Turn on the news or open a national newspaper, and there will be a story about immigration issues. And while reasonable people can debate whether or not illegal border crossing present a crisis, the fact remains that the majority of new people who are without lawful status in our country each year are people who came in legally, but who have overstayed a permitted visit. Several administrations have tried to find ways to address visa overstays, but how can the government initiate removal proceedings against someone who is under the radar? It appears as though they are finding ways.

To Be Or Not To Be...come A U.S. Citizen? That Is The Question!

Congratulations! You have become a Lawful Permanent Resident of the United States, with either a 10-year "Green Card," or a 2-year conditional "Green Card."  It has likely been a long road to get to this point, and you are probably tired of the process, the forms and the filing fees, but there may be one more form you want to submit when you are eligible to do so - USCIS Form N-400.  That is the Application for Naturalization, and one files it to become a citizen of the United States.  Some people cannot wait to take the oath of citizenship, while others are satisfied with having a Green Card, and wish to remain permanent residents. A subset of these individuals choose to remain permanent residents due to the long processing delays or to avoid the costs involved.  Others choose not to file due to tax implications (in the United States or abroad) or issues related to dual citizenship (or a lack thereof with respect to the country of their birth). With that in mind, Permanent Residents must recognize that there are risks to not applying for citizenship, and there are things everyone with a Green Card should know about the requirements to become a U.S. citizen.
