PROBATE:

Probate Administration
Dealing with the death of a loved one is one of the most difficult and emotional times for family and friends. This is made more difficult by the resulting legal implications. Often, one of the most pressing and complex legal issues is estate administration - the legal process of transferring the decedent's property or estate either through the provisions of a will, a trust, or the laws of intestate succession (if the decedent dies without leaving a will).

While the probate process can be time-consuming, difficult, and expensive, we work closely with family members to ensure a smooth transfer of the assets and estate of the deceased
. In addition, we recognize that often the family members and relatives of the deceased live out-of-state, and it can be difficult to deal with legal issues and proceedings that take place far away.  In turn, we work with out-of-state residents to facilitate the transfer of assets, and to ensure that the legal aspects of the decedent's passing are properly handled.  This allows family members and relatives to deal with the issues that really matter, rather than worry about the legal aspects of their loved one's passing.

Finally, should a dispute or a controversy arise from the probate administration process, we are available to assist clients in resolving various issues, including:

  • Will contests
  • Trust contests
  • Undue influence
  • Mental incapacity
  • Breaking or enforcing wills or trusts
  • Breach of fiduciary duties
  • Removal of executor or trustees
  • Purchase and sale of estate real estate
